By placing a plant order, the customer automatically accepts these terms of supply.

If deemed necessary by the sales representative, the order will only be finalized upon advance payment, which may be total or partial.

Changes or cancellations of orders can only be made at least 15 days before the scheduled sowing date.

Plants are the responsibility of the customer from the moment they are delivered.

The collection or delivery of trays with plants will be scheduled with the logistics department during the week prior to the planned delivery date.

If, for reasons beyond Plantalgarve’s control, the customer cannot collect or receive the plants on the scheduled delivery date (with a one-week tolerance), the nursery is not responsible for their quality at the date of the new delivery.

Returns of plants to the nursery are not accepted.

The choice of varieties is the sole responsibility of the customer. Plantalgarve is not responsible for the final outcome of the crop or for any changes in the characteristics of the variety, whether in plant development or in the final product obtained.

If the customer provides the seeds, Plantalgarve is not responsible for their germination vigor. The price per cell or tray will still be charged, whether germination occurs or not. The customer will be notified if germination losses are abnormal (exceeding what is expected for the species) or outside the agreed terms. Only orders with seeds in their original, commercially certified packaging will be accepted.

In case of a claim entitling compensation, the amount will not exceed the value of the plants delivered. In case of dispute, the Court of Faro shall have jurisdiction.

Trays carry a deposit, the value of which is updated according to the acquisition cost, regardless of their type. Trays must be returned in good usable condition within 60 days after plant collection or delivery. Otherwise, no credit will be given for the return.

If invoices become overdue and are not paid, default interest will apply at the minimum legal rate in force, under Article 102 of the Commercial Code.
